What is Music Licensing?

My very good friend took delivery of a new jeep recently and he came to my house to take me out for a ride in the new wonder on wheels. This has become a custom among close knit friends whenever there is a new acquisition. One of Jay-Z’s best albums, Blue Print was blaring out from the speakers in his car. The album used to be one of my favourites in those days. I later requested for the CD but he refused and in the course of our discussion, he proceeded to say that he has the right to do whatever he liked with the album (the songs inclusive) since he bought the original CD. We argued over the rights he professed for a long time before he finally succumbed. The argument brought about today’s topic- Music Licensing.
Music licensing is the certified use of copyrighted music as it prevents the unauthorized use of musical works. It ensures that the creators of musical works get compensated for their work. The fact that you purchase a 2Face Idibia or Black Tribe’s album does not give you any right over the songs. The only property of yours is the disc on which the music is stored and not the songs. You have limited rights to use and reproduce the recorded work. It is important for a musician to preserve his civil liberties, and that means licensing and copyrighting his work properly because this could mean big bucks for them if they wrote a particular successful song and someone wants to license it from them. Imagine if all the songs we listen to in Nigeria today on radio; hear in restaurants & clubs and other public places are all licensed. Our artistes would have sure made mega bucks. Before we go further, I will love to explain some terms in music licensing. License is the right approved by the copyright owner to broadcast, recreate, perform, or listen to a recorded copy of a copyrighted work, licensee is the person or entity to whom the work is licensed and licensor is the owner of the licensed work Pre-cleared music is the music that has been pre-negotiated for price; distribution and legal use, copyright is literally the right to copy, Synchronization Licensing is the licensing of musical works to be performed as a soundtrack or background to a motion picture, Master Use Licensing is the licensing of the recording of a musical work to be performed as a soundtrack, bumper, lead-in or background to a motion picture and a publisher is the owner of the copyrighted work. It is now standard practice for songwriters of even the slightest prominence to form a 'publishing company' who actually owns the rights to their work; the reasons for this are matters of legal finery and largely not of value to the scope of this article.
This is the world of music licensing; a world where the rights to use music are bought and sold every day. It turns out; however, that music licensing is something that happens constantly, all around us but the laws are not well enforced in this part of the world. Corporate bodies use musicians’ songs to promote their brands and get away with it here in Nigeria . An example of this is the case of Daddy U Turn and MTN and the artiste sued the company. It is in the same industry that artistes pay to get their songs aired instead of them getting paid for their songs.
Radio and TV stations pay fees for the rights to broadcast music. Fees are paid to licensing bodies. Radio stations calculate payment to license holders by periodically auditing the music being played. The audit results are submitted to the licensing relevant body for the station's territory. This information is used to calculate the average number of plays each artist has received. I don’t think there is any station in Nigeria now that obeys these laws but if there is, I would love to be corrected. I interviewed the CEO of Nigezie ( a 24 hours music and lifestyle channel) Femi Aderibigbe popularly known as Kwame in South-Africa in 2008 and he said they don’t know who to pay to. He said there is conflict of interests between the two collection societies in Nigeria whose fundamental job it is to keep track of every single performance or broadcast of all works protected under copyright. These bodies have the right to license, as well as the right to perform songs and musical works created and owned by the songwriters, composers, lyricists and music publishers who are their members.
Music licensing in the United States is made possible by the protection that U.S. copyright law provides for artistes. According to an article, the copyright code of the United States (title 17 of the U.S. Code) provides for copyright protection in sound recordings. It defined sound recordings as "works that result from the fixation of a series of musical, spoken, or other sounds, but not including the sounds accompanying a motion picture or other audiovisual work." Common examples include recordings of music, drama, or lectures. Technically, the registration process with the copyright office is not officially necessary in order for you to own the copyright. You actually own the copyright as soon as you create the song and write it down. However, to enforce the copyright in court, registration is required. Once you have the copyrights, you can sell rights to the song if you choose to, and you can also prevent anyone else from using the music, the lyrics or the actual performance of the song. You own the whole song and all the rights to it. You can license the song in any way. That is why the ranting of Konga made me laugh when he claimed the song 04Kasibe was his idea before Zeez recorded it and it became a hit. Another desperate young act looking for fame at all cost- Baba Nee claimed 9ice has been stealing his lyrics and so many other frustrated acts. If they are actually true to their words, they should present us with the documents.
There are several things that can be copyrighted in any sound recording for a song. There are the actual sounds themselves; the performance of the work. The notes that the musicians play to create the song too could be embodied in sheet music.
Several parties are involved in song licensing. The label owns the actual sound recording (the performance of the song as recorded in the label's studio). The publisher works on behalf of the song's composer (the person who arranged the music) and songwriter (the person who wrote the lyrics). The composer and songwriter probably own the actual copyrights for the song, and the publisher represents them in all business dealings.
If you want to use a song for any reason, you have to somehow obtain rights at least from the publisher, and possibly from the label as well (if you are planning to use a specific performance).

Sony Music UK Romances Soforte

Sony Music UK has entered into an agreement with Nigeria ’s first automated distribution company- SoForte Entertainment Distribution to make Nigerian music available whenever there is a demand for it anywhere in the world. Music distribution is finally taking a better shape in Nigeria . According to their publicist- MME (Media & Marketing Experts), the working relationship with Sony Distribution for international retail distribution deal was sealed few days back at the corporate office of Sony Music in the UK . The relationship covers international standard packaging for labels and Artistes working with Soforte Distribution. Sony would ensure product supply to its partner retail stores worldwide as long as demands come from them.
According to Mr. Gbenga George, CEO of Soforte and an entertainment lawyer, this is the beginning of the dream Soforte has for the industry and it is in line with its blueprint. “Nigerians living abroad can go into any major or minor media retail store anywhere in the world to request for their favourite Nigerian Artiste’s works from the stable of Soforte. The standard of music and music video in Nigeria of today is international quality and that should reflect in the quality of our CD/DVD packaging and deserving of international distribution. We encourage Nigerians living overseas to make it a habit to go into retail stores and order for Nigerian Artistes works just like they would do for the foreign Artistes”.
The company plans to roll out the most advance distribution technology system this year, this promises to take the industry to a whole new level enough to attract high level investments from corporate organisations and individual. Amongst the things to look out for this year is an automated CD/DVD vending machine easier to operate than the popular ATM machine you see around today. These machines would be deployed all around strategic places in Nigeria making CD/DVD purchase easy for consumers. The good thing about this is that it guarantees original CD/DVD sale which would in turn guarantee royalty payment to Artistes and labels, and returns on investment to investors.
Also, Soforte would introduce, for the first time in Nigeria and perhaps Africa, Direct To Customer (DTC) purchase service, to music buyers anywhere in Nigeria within 24hours. Leveraging on its strategic alliance with TNT/IAS courier and its over 60 warehouse locations nationwide and its tailor made software developed by Maevva Solutions (an American company with a base in Nigeria), music consumers would only need to order for their favourite Artiste CD/DVD via mobile phones or internet and delivery would be made within 24hours to home, office, etc. This would finally bring to an end, the stress of purchasing music products anywhere you are in Nigeria and also ensure purchase of original products.
The new product packaging which is called ‘Platinum Collection’ would be introduced in the next few months and fans of 9ice and Lara George would be treated to international quality CD, which they can be proud of.
Soforte is presently in talks with several labels and at the point of closing distribution and licensing deals with them. The CEO further assures Nigerians that this is the beginning of a revolution in the entertainment industry in Nigeria . He considers it the biggest export in Nigeria comparable to oil, if not bigger in terms of image and branding effect.

Blacktribe: We Don’t Have Any Problem with Faze

Even though it is yet to become public knowledge, it is gradually gaining prominence on the streets that one of Nigeria’s most talented vocalist- Faze and the longest standing hip-hop group in Nigeria- Blacktribe are having serious feud. This is not unconnected with a verse in one of the lyrics in the group’s new album- Addicted
The track that has been causing this controversy especially in Festac Town - the hood where the acts reside is titled Wondale featuring 2Face Idibia. We heard it has started causing serious trouble between the fans of Faze and Blacktribe in Festac Town and it had resulted to fights on few occasions. To finally bring this unnecessary bickering to an end, Young Chief, one of duo that make up the group has come out to address the issue in order to put it to rest.
“We don’t have any problem with Faze”, he said. “The concept of the song is for everybody to dance and be happy. The verse that is currently causing this controversy is where I accused a lady of standing alone like Faze. That we don’t want any maga whey go dull the place”.
On why he described Faze in such context, he said Faze does his things alone. “Faze is known as a very independent person. He is always doing his things alone. Since the babe decided to stand without mixing up, that is why I described her as Faze. With all due to respect to Faze”, he concluded.

The Steady Rise of Maye Hunta

Nigeria ’s fastest rising R&B singer, Maya Hunta popularly known as Ekaette ( Ekaette is the title of his latest single) is finally ready to release his new album. He revealed this to Rhythm & Sounds few days back. The act who returned from South-Africa to promote his songs has no doubt received massive acceptance from every sector of the society. He has become a darling to both the old and the young. For the past three months, there has been no day his music does not enjoy generous rotation on different television stations. He has shown through his lead single that he is here to stake a claim since his explosive entrance into the music scene.
Real Names Olumayowa Adekunle Odejimi, Mayé is a Nigerian singer, songwriter, record producer and actor. His surname Odejimi, in Yoruba language means the “crowned hunter”. Instead of using the word “hunter” he put a twist to it and made it Hunta – which is more African.
Maye once got three nominations at Channel O Music Video Awards such as Video of The Year, Best West African Video and Best Reggae Dance Hall Video. Since he returned into the country, he has been getting invitations to perform at different shows. He performed at Rhythm Unplugged last year December, Dynamix Awards Pre-Award party, to mention but a few. All these performances are part of the build up for his new album.
His soon to be released album is titled MAYEFESTATION which he explained as the manifestation of Maye. “The title of my album came to me as an inspiration. With the talent in me, I knew I’m going to be unstoppable in music. By the time I release my album, people would actually know the kind of stuff I’m made off. So the title of the album which is Mayefestation simply means the manifestation of Maye”, he explained.
His new album is going to contain 14 tracks and two skits featuring Sound Sultan, ID Cabasa, Tosin Igho and Male from Swaziland . He is currently signed to Made Entertainment.
Mayé 's love for music dates back to his childhood days (he was a member of a boy group called Basic Boyz as well as the Pentecostal Church choir), but it was only in 1998 that the music bug bit him and he decided to take it up as his career. At the age of 13, Mayé and his group members co-wrote their first song titled 'Who Is She?' and even though the song was never recorded it made a mark in his life. He crossed over to South African shores to further his education in 2002.Throughout this time music was still his biggest priority and so he took his demo to major labels and it eventually caught the attention of an A&R executive at Gallo Records. He was then offered free studio time to record another demo at Gallo Records’ “Down Town” studios in Newtown, Johannesburg. Negotiations for a record deal based on the demo were in the pipeline but this never happened as the said official left the company.
Things changed for the better when he met fellow Nigerian, songwriter, producer and Kora and Channel O Music award winner- Kunle Odutayo who went on to become his close friend and producer. He also met another fellow Nigerian, Channel O’s DJ Waxxy. Together Mayé, Kunle and Waxxy went on to form a synergy.
In late 2004 Mayé joined the band 'Kunle Ayo' as a back up vocalist and they have since performed at major jazz festivals around South Africa, such as the Standard Bank Joy of Jazz, sharing the stage with heavyweights like Dave Koz, Kirk Whalum, Hugh Masikela and Richard Bona, just to mention a few. This inspired the rising star to pick interest in the acoustic guitar. Although not a master of the guitar yet, playing around with the instrument inspired him to write most of the songs that will be on his new album. Though no definite date yet for the release of the album, he said the album will hit the shelves in a matter of weeks.

Questionmark Records Positions

The CEO of Questionmark Records, Kelvin Luciano is currently in South-Africa sealing some juicy business deals. The label management revealed to us few days back that their boss just bought over an entertainment company in South-Africa. They revealed the name of the outfit as Pyramid Entertainment which is now the office of Questionmark Records in South-Africa. Aside that, they also squealed that the clothing arm of the company is about to commence.
In a bid to also promote the new acts on the label, the three signed-on acts on the label, Harrisong, Ego and D Supremes will leave the country in a matter of days for South-Africa to shoot videos for their promo singles to further aid the popularity of the artistes.

Eva Steps Up

One of Nigeria ’s budding vocalists- Eva is about to permanently stamp her reign in our faces. One of her new videos has been getting airplay on different television stations across the country.
She has shot the videos of two songs from her self titled new album. The songs are Na So and God’s Hand. Both videos were directed by award winning director- Gbenga Saliu.
Na So was shot in a ware house in Ajao Estate and God’s Hand was shot in a studio on Allen Avenue in Lagos .
Towards the end of last year, the gifted female vocalist debuted with a 16 tracker self titled album- Eva. Some of the tracks on the album are Motherland, No Cry, E Wa Bami Jo, I Still Dey and others. The album has the production imprints of the likes of Mastermindez, Etwinz, Wole Adesanya, Ini D’Minstrel, Shogon, FFD and Timsonic.

Puffy-T Plans Album Release

One of Nigeria ’s top producers- Puffy-T might debut with his own album before the end of the year barring any change in plan. Having produced hit songs for few acts, the A-list producer felt it is high time he came out with his own album. Speaking with Rhythm & Sounds few days back, the highly praised producer said his album would be dropped before the end of the year. “It’s not something I’m actually planning to do but there is pressure on me here and there to come out with my own album. Nomoreloss heard some of my songs and he marveled. I’m under his management right now and it is a project we are both working on together”, he revealed.
Puffy-T shot into the lime light after producing Yahooze for Olu Maintain. The song became the toast of all fun lovers and no party was complete without it. Ever since he has become one of the most sought after producers in Nigeria . He was also responsible for producing the monster hit- Lorile for X-Project.
We all know that releasing an album is not actually the main issue but making a success out of it is the most important thing. We will keep our fingers crossed and see if he can make a success out of this new phase of his life.

Jeremiah Gyang Returns

The phenomenal singer- Jeremiah Gyang sure needs no introduction. It’s been five years now since he swept us off our feet with his hit single- Na Ba Ka. The song ruled the airwaves for a while and made him one of the most sought after acts then.
2010 is actually looking very bright for the J-Town boy singer. His sophomore which is yet to be titled will soon be released. Those who have been privilege to listen to some tracks on the album gave Jeremiah kudos.
It’s been over five years since his phenomenal debut opus: ‘Na Ba Ka’.
While building the tempo and necessary buzz to prepare us for his sophomore LP, Jeremiah has sung a duet with Asa - ‘Comforters Song’, crafted songs for L’ami and other upcoming artistes and performed at the December 2009 Rhythm Unplugged Concert in Lagos.
In the spirit of the Valentine season, Jeremiah has put out a free promo CD ‘The Return of Jeremiah’ which includes the new singles ‘In Love with You’, ‘Kaunar Allah (Ft. Skales) and ‘The Only One’.
The tone of these songs, which evoke feelings of love, not towards the artiste but towards a lover, spouse or partner, showcases the deeper and more mature side of the artiste/producer.

P-Square Move into New House

There is no doubting the fact that it is now public knowledge that the duo of Peter and Paul popularly known as P-Square are currently building a house inside Omole Estate in Lagos . By the time they move into the building, it will become their second property in Lagos . In a chat with Rhythm & Sounds few days back, Paul revealed that they should be moving to the house by March this year. “Everything that needed to be done has been done. They are about completing the plastering. By March, we would move to the house by God’s grace”, he revealed.
The new house is a twin duplex of four rooms and two sitting rooms each. In addition, it has a standard swimming pool. The Okoye brothers are doing everything possible to make the house the best it can be.. The most important thing they won’t joke with in the new house is the installation of a recording studio.
Aside the Omole property, they bought a house in Lekki a couple of years back. They also have a property in Jos and according to Paul, the completion of their Abuja property will be fourth.

Segun Obe Steps Aside

Great vocalist, Segun Obe is repackaging. If you are wandering what it is, he is taking a break from music to exhibit other talents of his. Even though he has recorded some songs off his forth-coming album, there are no plans of releasing them now. Segun has started a programme on TV called ‘Chilling Out With Segun Obe’. It’s currently airing on a particular Television station in Lagos every Thursday. One of the basic concepts of the programme is to interview musicians like him from the artiste’s perspective to reveal the challenges they faced in their career and the stress it takes to bring out an album.
Speaking with Rhythm & Sounds few days back, he revealed that the programme is about to get bigger. “We just got the support of Chivita. They are interested in the programme. I would soon start voice training too for some budding talents in Nigeria . I will be traveling to America soon to shoot some videos and also record some episodes of my programme with some foreign acts. I’m doing lots of things at the moment”, he said.

The New Face Of Music Distribution In Nigeria

The music industry in Nigeria has no doubt come a long. But a lot still needs to be done before we can finally say a structure has been put in place. Until our artistes start earning royalties accordingly from their album sales and the laws of music publishing are rightfully enforced, we will continue to have a music market like we have now and the dream of a well structured industry will continue to elude us.
What exactly is he ranting about this time around you might ask? In your own verdict, you may believe that our artistes are doing very well probably because a handful of them are building or buying houses, driving exotic cars and enjoying other good things of life. But in case you don’t know, they are at the mercy of the corporate bodies and other promoters. They are not maximizing their potentials and invariably not making the right amount of money they ought to from their profession as artistes. When four of the most successful musicians in Nigeria pool resources they might not be able to withstand a Jay-Z or 50 Cent in terms of wealth or material acquisition. This is the genesis of my ranting and the underlying will make you see reasons.
I went out last week to purchase some music albums. I checked through my music library and I realized that most of the people that borrowed the albums from my library hadn’t returned them. I got all the albums that I intended to buy including Plantashun Boiz’s debut album. To my amazement, most of the albums were recently printed because they looked so mint fresh. From Faze’s debut album, P-Square’s Busy Body, D’Banj, Jazzman Olofin and many others who had released their albums a couple of years ago, most of the jackets were still looking very fresh. After buying the albums, I wondered for long if any of the artistes of the over 50 albums I bought will have their fair share of the money I had just spent. Let us even assume that some had sold all the rights to the cabals in Alaba International Market, what about the ones that were properly signed unto a record label as at the time the album was released and the label was the sole marketer of the album? This is gross injustice, I reasoned. These artistes are entitled to a percentage on every CD sold but it is very unfortunate that most of the artistes do not even know their rights.
There is the need to create a scientific entertainment distribution template towards giving a structure to the music industry in Nigeria . Some of the objectives should be to reduce the scourge of piracy to the barest minimum, maximize unit sales of entertainment products, enthrone the tradition of royalties as a norm in the industry, to ease customer purchase process through the use of technology and reduce the current chain in the distribution network, thereby increasing returns on investment to the stakeholders.
I’m fully in support of the rally that was staged in Lagos on September 1st, 2009 against piracy. It attracted the attention of ailing President Umaru Ya’adua and he wrote a letter to Alaba Market warning them to desist from piracy or else face the full wrath of the government but it is quite unfortunate that that was the end of the threat or so it seems. Few months after the rally, the widely acclaimed king of pirates in Alaba International Market, was arrested. He was caught with thousands of pirated copies of various Nigerian artistes. He was arraigned at Federal High Court in Ikoyi on February 1st, 2010. The hearing is expected to be on February 18th and 23rd. Until then, he has been remanded in police custody.
The business of music has three components: production, marketing and distribution. Each of these components is susceptible to technological changes that threaten to destabilize the established mechanisms of the music industry. It is difficult to have a discussion about music distribution without discussing music marketing because the distribution parameters are dependent (in part, at least) upon the success of the marketing plan. Furthermore, these dual aspects of the music business are becoming increasingly intertwined where both can occur in the same place and at the same time.
Distributors get records into retail stores, and record labels get customers into retail stores through promotion and marketing tactics. An artiste must make sure that there is a market for his style of music and prove it to distributors by showing them how many records he had sold through live sales (performance in shows and concerts), internet sales, and any other alternative methods.
Distributors will only be as good as your marketing plans to sell the record. No artiste should expect the entire work to be done on his behalf, remember all that the distribution firm does, is to get records into the stores. An artiste or the label must work on the product relentlessly on as many fronts as possible with commercial and non commercial airplay, internet airplay and sales campaigns, on and offline publicity ideas and touring…eternally touring; everything necessary to create the much needed demand.
The label/artiste must keep the distributor updated on any and all promotion and marketing plans and results, as they develop. Trying to work with distributors without a realistic budget to participate in promotional opportunities would be a big mistake.
You must make sure that your distributor has the ability to help you setup various retail promotions such as: coop advertising (where you must be prepared to pay the costs of media ads for select retailers), in-store artist appearances, in-store listening station programs, and furnishing POP’s (point of purchase posters and other graphics).
I want to believe that it is clear up to this level. Most of us can now understand the difference between marketing and distribution. I hear many artistes every day including the established ones saying they are still looking for a marketer. In my humble judgment, you or your record label should be the marketer of your album because the much market you are able to create for your product will determine the success of the distribution. We are getting so many things wrong. Alaba market should not be the alpha and omega i.e the major determinant of what happens in the distribution market. These guys are mere wholesalers and retailers (and vendors if you like) but the industry has decided to turn them into demi-gods. All that most artistes think about now is how to give their albums out completely to one Alaba so called marketer who in return gives them a paltry amount of money in exchange for their intellectual properties which in the actual sense should put food on their table forever. They even praise them now. “We go to Alaba and make some money”. This much Weird MC reiterated in the lyrics of one of the verses on her song; Riranwo.
Granted, we can’t completely rule out Alaba for we still need to thank these guys for their assistance in getting out the albums on the street, but it is time to move on to the next level. T-Joe and Happy Boiz Entertainment were quick to understand the need for proper distribution networks but they still haven’t gotten the entire concept correctly. It’s still the same old style. The only company that has gotten it right for now is Soforte. Without sentiments, these guys deserve to be applauded. We need more of the likes of Soforte in the Nigerian music industry now.
Soforte is the first automated entertainment distribution company registered under the laws of the Federal Republic of Nigeria. So far, they have created the largest distribution network comprising of both locations and supply chain distribution with outlets in over 60 key locations nationwide and well over 800 Wholesalers and Retailers spread across several business districts all across the country.
They have formed several strategic alliances with key organizations in Nigeria , amongst which are TNT/IAS Courier Company (TNT) and Maevva Solutions. TNT handles the entire back-end logistics service for Soforte; ensuring products are delivered to all distribution outlets nationwide
Another first in the music and movie industry from the stable of SoForte is the provision of holograms for CDs. This security code helps to further protect the product from piracy and also helps to distinguish between original and pirated works, thereby making for easy prosecution of offenders.
Finally, they have also pioneered the use of barcodes for music works in Nigeria . This barcode is recognized in any store or mall worldwide and more importantly by Nielson Soundscan, the largest marketing and media information company in the world. The barcode is product specific and it’s used to trace sales anywhere in the world through a barcode scanner. Nigeria ’s music industry is growing so fast that our products are beginning to sell in millions of copies outside the shores of this country and it is very important, for the sake of the IP owners and stakeholders and investors to be able to capture sales no matter where it is effected in the world.
Soforte Entertainment Distribution presently works with the following licensed Artists; Lara George and 9ice while they are in talks with other acts. It is now clear that we need another Soforte like figure in the industry without necessarily destroying Alaba. They can continue to be organized and licensed wholesalers or retailers while the activities of the market are greatly monitored. Whether the leader of Nigeria Copyright Commision- Adewopo should be sacked or retained is another story for another day. Does NCC even exist for the purpose of its creation? There is a serious vacuum in that office and it appears they have misguided priorities.
More importantly, our artistes and some record labels need to be tutored about marketing of their albums online. They should ask 9ice how much he has made on the internet from his new album. So far, he has raked in more than a million naira. There is a huge market online and yet they can’t see it. It is not actually something I can discuss in detail with very few lines on my page. I will advise they see the professionals. There are so many sites online you can sell your songs.

2face Steps Out With Annie Macauley

On Friday February 6th, 2009 in Maitama at the Federal Capital Territory, Abuja, multiple award winning artiste, 2face Idibia and one of his baby mamas, Annie Macauley were the cynosure of all eyes. Lots of people were taken aback when they saw the two love birds. They were spotted at the launching of a new club in Maitama christened Terminal Five. 2Face was invited as a special guest of honour to witness the launching of the new hangout. In order to have the best of time in Abuja, 2Baba as he is fondly called resolved to come with Annie Macauley. A close buddy to the love birds divulged they came with their daughter but they didn’t bring her along to the club.
Few weeks back, Annie denied being pregnant for 2Face again claiming to be too busy to be involved in such act.
