Understanding Music Publishing

September 1st, 2009 marked the no music day in Nigeria, a strategy to further strengthen the anti piracy campaign spear headed by a coalition of groups and stakeholders in the Nigerian music industry. Even though most of the media houses failed to co-operate with the coalition, it clearly exhibited how difficult it is to exist without music. This is the main reason why the intellectual rights of the musicians churning out these songs should be adequately protected.
Along the line, Rhythm & Sounds realized that so many artistes didn’t understand music publishing. The most surprising aspect of it all is that the CEOs of the many mushroom record labels springing up at the moment in the music industry are completely ignorant of this topic. Since the music industry is approaching a stage where any music played on air or used by any organisation will be paid for, it is important that music practitioners understand the importance of publishing in music business.
Successful songwriters and composers have a relationship with a publishing company which is defined by a publishing contract. The publisher agrees to see to it that the composers receive royalties from various uses of their compositions. They also provide substantial advances against future income. In return, the publishing company receives a percentage, which can be as high as 50% and varies for different kinds of royalties.
As a songwriter, you earn money by licensing your songs for various uses, and collecting the corresponding license income. This process of generating income from your song writing is music publishing. To understand music publishing, you should understand the distinction between a song and a sound recording. A melody and any accompanying lyrics make up the song or the musical work which is the term used by the Copyright Act to refer to a song while a sound recording is the recorded performance of a song. You should also understand the exclusive rights a copyright owner holds to his songs and sound recordings.
While some songwriters choose to handle their own music publishing, many songwriters work with a music publishing company. Music publishing companies are important in at least three areas. Naturally, their most important function is marketing and promoting your songs. Secondly, the music publishing company handles all the administrative paperwork involved with copyrighting, licensing and collecting royalties for your songs. Finally, a music publishing company may help you develop as a songwriter by finding other songwriters and lyricists with whom you can collaborate.
You've written a song. You've carefully prepared it in manuscript form. You've researched potential music publishing companies and submitted accordingly. Now the moment you've been waiting for arrives: You've been offered a contract! But that contract as well as your verbal negotiations with the publisher is filled with words you're not quite sure you understand. That's when you realize the importance of researching music publishing key terms.
Fortunately, no publisher expects songwriters to be fully versed in legalese. There's absolutely nothing wrong with asking for a clarification of terms. But you shouldn't rely solely on the publisher's explanations. If you want a fair contract, it's important to educate yourself first. It is significant you know the three main types of music publishing terms which are used to describe rights, there are words a music publishing company uses to explain contractual obligations and miscellaneous, terms that may be tossed your way.
There are a wide variety of rights a songwriter may sell, and it's vital to understand all terms related to this part of the business. Some of the most common terms used regarding rights include 'blanket license' (referring to rights given by a songwriter's group authorizing performances of a particular song), 'mechanical license' (allowing the recording and distribution of a song on CD) and 'print license' (allowing a music publisher to print and distribute a piece of music).
Although no one expects this to be your area of expertise, songwriters should at least have a basic understanding of certain fundamental contractual terms used by publishing companies. These include 'advance' (money paid to songwriter by a publisher; the publisher then keeps all royalties earned from the song writer's music until the advance is paid off), 'mechanical royalties' (paid to publishers and songwriters for the right to record music), 'synchronisations royalty' (paid when music is used for a film, television program or commercial) and 'work made for hire' (music created by an employee as part of a job or any music that is commissioned; in these cases, the songwriter does not own the copyright to the work).
The miscellaneous terms you may come across while getting your music published in printed form are 'collective work' (referring to a collection of songs copyrighted by several individuals), 'compilation' (a collection of songs that may be copyrighted by one or more individuals) and 'derivative' (a piece of music based on one or more pre-existing songs).
No matter how educated you are about sheet music publishing and music publishing contracts, never neglect to hire an attorney to review anything you're considering signing. Be sure the attorney specializes in entertainment law since music industry contracts are highly specialized.

Album Review

Artiste - Iyanya
Album Title - My Story
With so much pressure these days on artistes to hit it big with their first albums, it is not surprising that young artistes and producers would look to proven styles and artistes for inspiration. It appears as if Iyanya wants to be everything to everyone. He makes recognizable sounds and tap into established fan bases which is not a bad way to approach a career. _Without question, Iyanya is talented. If he isn’t, he would not have emerged winner of MTN Project Fame a couple of years ago but it actually takes more than talent to come up with a good album. It takes real skill to create a song in a recognized style and nail all the things that make the style great while avoiding sounding like a mere parody.
Iyanya has released an album that will give him an opportunity to either swim or sink on his own. We understand it’s a tough task of transition from teen heartthrob to a full-fledged R&B or Pop star. Luckily, he has a firm grasp on the importance and delivery of lead singles, Love Truly and Shaye but he still has plenty of work to do when creating a full album.
The whole album is made of 14 tracks and about one hour total listening. It favoures collaborations from MI, Zeez and Bokwilla, Faze and Ugly. The album has the production imprints of K-Solo, OJB, Wazz Beatz , ID Cabasa and TY Mix who actually produced 50% of the album._The album opens with Gbadun You, a soul touching hip hop song over an upbeat beat featuring MI and followed by a more contemporary afro hip hop song titled Wise Up. In as much as Inyanya is trying his hands on different genres of music, sampling so many others, he still has few slower cuts that actually leave indelible impression of emotional gush on one’s mind. Such tracks are Forever, Love You and Love Truly. He shared the mic with Faze on No Time and Ugly on Gongon. The remix of Love You Truly with Bokwilla was a good attempt. Bokwilla actually justified himself as dancehall act of repute that knows his onions in that genre of music.
Inyanya was probably so carried away with finding his way around the music of the time to have a popular song on the street that he forgot to display his vocal dexterity and lyrical prowess in order to establish himself as an R&B artiste to cut. We actually expected Inyanya to have poured more soul and emotions into this album.
Even if there are a handful of tracks that should’ve been shaved off, there’s nothing outright bad on True Story album and a lot that is good. It probably might not be a standout in the overall catalogue of music albums but it is indeed a solid one nonetheless because his versatility is intact. It is literally a perfect example of a teenager becoming a man.

Kenny Saint Brown Drops New Album

The never-say-die gospel artiste, Kenny Saint Brown has finally released her new album titled Turn Me Around. The album was released few days back on Kennis Music label.
In a text message she sent to Rhythm & Sounds, she disclosed that it took her one year to come up with the new album. Her lead single- Turn Me Around featuring Dagrin has provided the much needed hype for the album to ride on.
The album is made up of 12 tracks with collaborations from different acts like MI, Terry G, Dagrin, Eldee and Ice Prince. It has the production imprints of talented producers like ID Cabasa, Terry G, Sheyman, Eldee Da Don, Jesse Jags and Yomi Omidiran.
Some of the songs on the album are Live Your Life, Mo Ti Goke, Sugar Sugar, Alaye, Heaven’s Smile, Abanikanda, Nothing 2 Something and others.

9ice Sells Two Million Copies

Contrary to public speculations that 9ice’s new album is not generating sales, the company that handles the marketing and distribution of the album- Soforte Entertainment Distribution has come out to dismiss such claims. According to the CEO of the company- Mr Gbenga George who chatted with Rhythm & Sounds on Tuesday January 27th, the album has been doing tremendously well. “I laughed when I heard that 9ice’s album is not selling. I wondered for long what their yard stick was. We keep moving units since we released the album on December 7th. As I speak with you right now, we have thousands of orders we are yet to supply. So far, we have sold up to two million copies of the album”, Gbenga said.
Gbenga later buttressed his points with how the company works. “It’s very difficult to cheat an artiste on Soforte because everything is computerized. Our artistes have the opportunity to go online and check the figures of their sales. Soforte has created a scientific entertainment distribution template towards giving a structure to the music industry in Nigeria . Some of the objectives of the company are to reduce the scourge of piracy to the barest minimum, maximize unit sale of entertainment products, making royalty a norm in the industry, to ease customer purchase process through the use of technology and to reduce the current chain in the distribution network, thereby increasing returns on investment to stakeholders”, he disclosed.
Soforte is the first automated entertainment distribution company registered under the laws of the Federal Republic of Nigeria. So far, they have created the largest distribution network comprising of both locations and supply chain distribution with outlets in over 60 key locations nationwide and well over 800 Wholesalers and Retailers spread across several business districts all across the country.
The company was the first to introduce the provision of holograms for CDs. This security code helps to further protect the product from piracy and also helps to distinguish between the original and pirated work, thereby making for easy prosecution of offenders.
Finally, they have also pioneered the use of barcodes for music works in Nigeria . This barcode is recognized in any store or mall worldwide and more importantly by Nielson Soundscan, the largest marketing and media information company in the world. The barcode is product specific and it is used to trace sales anywhere in the world through a barcode scanner.

Olu Maintain, Kentro World in Crisis

If the news reaching Rhythm & Sounds is anything to go by, then Olu Maintain and his Kentro World crew might soon fall apart like a pack of badly arranged cards. Sources claim that they have been playing hide and seek game of recent. One of the most shocking revelations was that Olu and the Kentro Boys didn’t have any contractual agreement. This explains why some of them have been recording with Puffy T without the knowledge of Olu Maintain. The source later added that the boys are however enjoying the hype and the exposure they are getting from being members of the group. Some of them have been able to travel out of the country and appear on major televisions. At present, none of them is in the country.
Rhythm & Sounds tried to speak with Olu Maintain but to no avail. We were later informed that he travelled out of the country on Sunday January 24th, 2009. We later placed a call to Puffy T and one of his close allies confirmed the development. “I can’t confirm to you whether they have an agreement or not but I can authoritatively reveal to you that some have recorded some songs with Puffy T without Olu Maintain’s Knowledge”, he disclosed.
Puffy T produced Yahooze, the popular song that re-launched Olu Maintain into mainstream music and stamped his feet on the scene as a solo artiste. They disagreed on lots of issues later and it created a crack in their friendship. That marked the end of their working relationship.
On the sleeve of his new album, Olu revealed that his favourite producer is TY Tayo Adeyemi a.k.a Snoop. He produced 90% of the songs on Olu Maintain and Kentro Crew’s new album titled With All Due Respect. According to Olu, he will remain his best producer ever. “TY Tayo Adeyemi a. k. a Snoop, we owe this album to you. You are my best producer”. These are the words on the jacket of his new album.
The new album contains 21 tracks with numbers like Arab Money, Tomato, Mama, Speechless, Takerewa, Legends, Keeping Faith and others. After the Yahooze album, lots of people had wondered if he would be able to replicate the success and mileage he got from the Yahooze album with his sophomore but he failed to replicate that feat. The album has been widely criticised across the broad spectrum of the media,
Olu introduced the Kentro world to the media in 2008.

P-Square: Forget Nigerian Awards

The name P-Square will definitely ring a bell anywhere music is being discussed in Africa . They have become one of the biggest music exports out of Africa . They started their career with nothing but talent, courage and the determination to succeed. Today, they have become one of the richest acts in Africa driving choice cars and living in posh apartments. They have carved a niche for themselves through their soothing lyrical wit coupled with percussive beats. They spoke to SEUN APARA

They looked so simple and casual last Monday evening watching the on-going Africa Cup of Nations and at the same waiting for this reporter to arrive for their interview. After exchanging pleasantries and catching up on old times, we moved from the sitting room to the dinning to conduct this interview. They have not actually spoken about the success of their latest album since it was released. That was where the interview started from. “It is a successful album. We sold a million copies after eight days. That was fantastic. We performed almost everyday through out the month of December and the album is now everywhere in Africa . We are getting ready for Invasion Africa season two”.
How did they receive the criticisms that followed the release of the album? “It’s bound to happen. We will tell you that we didn’t even receive much criticism on this one like the ‘Game Over’ album. It seems as if people are now used to our style of music. All they do now is to buy and listen”
“We came to realize that one of the problems we have right now in the industry is that people believe the songs that are played in the clubs are the hit songs and they lose focus of releasing songs with good contents. All we need to do is to do music and the society will choose their favourite. Some people now believe only in the instrumentals but music is more than that. The beats, the songs and the delivery should be perfect. When you have a better understanding of what music is, you will let it flow. ‘E No Easy’ was not recorded as a club song but is now one of the most played songs in the clubs. We advise that people should do good music”.
Lots of people refused to play ‘Danger’, one of the songs on their album in their various homes during the festive periods due to the lyrics. It’s however suprising that they felt the same way. “Even we P-Square felt the same. Nobody wants to see wahala (problem) or danger but that is not the concept of the song. At every point in life, one is bound to face danger. The song literarily explained what we went through in our career before we got to where we are now. It means that anybody that wants to enter our shoes too must see danger (laughs). Anyway, Danger was not the main song on the album but only an introduction to it.
They revealed what kept them going. “We believe it is the love for what we are doing and because we know what the people want. We have not changed and we don’t listen to people. We tried to develop ourselves which has really helped us. The ‘Do Me’ track you listen to in Nigeria is different from the Do Me you will listen to in other countries. They tried to play it with their own house beats”.
What informed their decision to start performing live? “We believe that is the way music ought to be done. The truth about this issue is that we play with a live band most times outside Nigeria . Why are we not replicating it in our country? Why are they always making us to perform with CDs? We have stopped that anyway and there is no show you would catch P-Square performing in that act again. Even when the organizers cannot afford the equipments, we go there with ours. We believe it should be encouraged by all the artistes. It is time to start doing music. People need to hear something different from the CDs they listen to every time in their respective homes”.
The twin brothers also explained why they sampled Busta Rhyme’s video to shoot theirs.
“It’s very simple. One of the reasons was that we are tired of seeing some videos we see on air everyday. They all look the same. The same song-Danger was meant to feature Busta Rhyme before everything turned apart. We only tried to do an international video out of Africa and people enjoyed it.
“The new one too is very simple. We just want to do something different. We have done so many love videos in the past where a guy will be holding a lady’s hand and be singing for her. So in this case, we decided to do something simple without any complication for the artiste. Soit is simply for people to enjoy the song”.
They explained how they feel being one of the most popular groups in Africa “We feel great and honoured. We are doing everything possible to maximize it because every artiste has a life span.
They can’t even count how many shows they play week in week out. “That is a very difficult question to answer. We play gigs like everyday. We know of the places we are going next week but we don’t know the ones that will follow. It’s very difficult for us to count.
“We are working on whole lots of stuff. People should expect the Invasion Africa Season Two. We are also working on Invasion Europe and America . At the same time, we are working on some other videos like Possibility and Break It. We are working on lots of things actually. Due to our time table this year, we might not be able to achieve everything but we pray that God will help us.”
They also took their time to speak on insinuations that they have been boycotting awards organized in Nigeria or by Nigerians. “For P-Square, we are occupied. If what people think is that we are boycotting award ceremonies, it’s not completely true. You don’t expect us to return money for a concert we have been paid for because of an award. Another important thing is that we have created a name for ourselves. So other artistes need the awards more than us. Look at our shelves, they are full of awards. We don’t even have space for them anymore. We are sorry to say this but awards mean nothing to us again. Some will even call us that if we didn’t come, they will give it to someone else. We just felt other artistes need them more than we do. What we are saying is we can’t cancel our show for any award”
“ It is true that we cancelled a show for MTV Africa Music Awards in 2008 but it will never happen again. We knew how much we lost for that single show”.
They refuted allegations that stopped because they didn’t win some categories as expected. ‘Let’s even face it. Everybody loves awards but does it put food on our table? Definitely not! There are lots of stuff that happen behind all these awards that people do not know. When the sponsors give them money, they will go ahead and do whatever they like and be deceiving people. We know all these but for P-Square, we don’t need it”.
“There is no credibility in all the awards organized in Nigeria . I think they have to hear it from the horse’s mouth. They should be doing the awards for the upcoming acts and not for P-Square, 2Face and the rest. We don’t need it”.
Why the sudden change because they loved awards in the past? “Yes but not anymore. It got to a level that it became a headache. I don’t think R-Kelly won so many awards. We just advise they give it to the upcoming ones to ginger them up. We are old now (laughs)”.
What if they are nominated for Grammy? “That is the step. Not these ones. We will definitely go for Grammy”.
“We will definitely go for Grammy. We will cancel the show because it’s worth it. Would they still attend awards organized in Nigeria ? “2010 is a new decade and there are whole lots of things to be achieved. If we are free, we will attend. If we deserve it give it to us but if you we didn’t, give to the person that deserves it”.
“Maybe we have already made up our mind actually because there are whole lots to be achieved in the industry not awards. We don’t even have space for plaques anymore. Let them give it to those that need them. We are not saying awards are completely bad; they are good no matter how old you are. Some little kids from one school recently gave us an award and we love it. Even though it’s made of wood but we still appreciated it. But you know what; P-Square is much occupied. Award organizers are doing their awards to make money; we too should be doing our concerts to make money, Period”!
“It now looks as if they are sharing it. Many of them will come out and campaigne for people’s votes but the votes were never declared for once. They enrich themselves through that means and they think we didn’t know (laughs)? If you invite an artiste for an award, you don’t have to beg him to come. Some people will go to the extent of begging us that if we didn’t come, the awards will not be fantastic. My God! You don’t have to do that. If it has credibility, nobody will want to miss it. You will leave whatever you are doing to be there. We have been to international awards and we all enjoyed it. Another problem is everybody is doing awards. We too can wake up tomorrow and do P-Square Awards. You can imagine the number of awards in Nigeria every year. We just felt these things ought to be checked. The sharing we are talking about is awards A will give best song to his person while awards B will give same category to his own person. The same thing happens with all music awards in Nigeria . It calls for reasoning. One will start wondering if it’s not the same set of people that are voting for the categories. Everybody is just after their pockets. We think they should all come together and put a stop to it.
They also commented on the state of the music industry. “The most important thing right now is for us to do the right thing. Even though the leverage is still there for us and things are getting better by the day, so many things still have to be done because it’s not applicable to other acts. God made ours possible because we do lots of shows especially outside the country. There should be a way to curb piracy and encourage royalty from airplay. Even if we A-list acts try to enforce it, the upcoming ones will still offer them money to play their videos because they are very desperate. So many things are even wrong with the Nigerian system. We have not had a president for more than two months”.
“We are getting the fight wrong because we are doing it by ourselves. We need to involve the government. LASTMA has been able to curb traffic in Lagos and EFCC has been able to curb corruption. So let the government create a security outfit like that for piracy. If our CDs are selling for N500, they can take N100. EFCC are fighting corruption because they know that something will definitely come for them anytime they win. We still feel that the body should be under EFCC because it’s part of crime. We heard some people did hunger strike at a time. They demonstrated and later went to Abuja to collect some millions”.
“That is what we heard. Let’s assume we have been on hunger strike since then; we would have been dead by now. Nothing good came out of the hunger strike”.
The brothers are not planning to get married soon. “We will get married someday but we are not thinking about it right now. We will do that at the right time.
But Peter is already a father? (Peter cuts in) There is nothing wrong with being a father but marriage is a different thing. And Paul has a fiancée in the University of Abuja? (Paul screamed) who told you I have a fiancée? You revealed her to me about two years ago?
Yes I did but I didn’t say she is my fiancée. She is my girlfriend and we are still dating. She is about graduating and after that she needs time to settle down and be independent. At the right time, we will all get married. I can’t imagine my wife telling me that I should stop removing my cloths on stage (laughs).
They also spoke about celebrity marriage break ups in Nigeria . “We think people got to know about these break ups because they are popular. There is divorce in every sector of the society. We musicians need to marry someone that is our friend. Someone that is used to us and understands us perfectly than marrying someone who barely know anything about us. It’s a very sensitive issue”.
They felt bad for their colleague- 9ice who recently broke up with his wife. “We felt very bad. We are good friends because he is a wonderful person. He was actually here and the only thing we could say is sorry. When we read it in the papers at first, we thought it was not true until we saw him and he confirmed it. He knows better actually because he is the one wearing the shoes. So who are we to comment? But we were pained when we heard.

2FACE STEPS UP WITH RANGE SPORT 2010

Multiple award winning super star, Innocent Ujah Idibia popularly known as 2Face Idibia has stepped up big time. It was a big celebration few days back at Festac Town, Lagos to celebrate the arrival of his new wonder on wheels, a Range Rover Sport 2010 model. Different kinds of drinks flowed endlessly.
Contrary to the opinions of people that the new ride might have set him back with millions of naira, it was actually a gift from a dependable ally that has been there for Mr Idibia since their roads crossed. His name is Aye and he hails from Warri in Delta State. Another artiste that is about benefiting from his largesse is Sound Sultan.
The ride came in a black colour with a customized plate number- 2BABA with other great accessories to treasure. The ride is the latest version of Range Rover Sport produced by the manufacturer which is an addition to 2Face his Armanda Jeep.
The Range Rover Sport looks as upscale as its price suggests, with an abundance of soft-touch plastics, softer leather, and wood trim. The wheel arches have been redesigned to improve aerodynamics and highlight the 19- and 20-inch wheels. Additionally, the entire infotainment system is much more intuitive and half of its buttons have been eliminated. Optional adjustable side bolsters help the front seats fit drivers of all sizes and the seats are more comfortable to boot.
Like the other 2010 Land Rovers, the Range Rover Sport has a lot of optional gadgets. The surround-view camera system is very helpful during off-road excursions, though Range Rover Sport owners would be wise to use it during parking maneuvers to keep those big wheels free of scuffs. High beam assist allows the vehicle to automatically switch between high and low beam headlights as traffic allows. The hard drive navigation system is much faster than the old system and iPod integration is very good.A fancy, 5.0-inch TFT display is situated between the speedometer and tachometer, but currently it can only display basic information about the vehicle.
